Single User Licence Agreement (Brushes & Tools)

All Brushes, Creative Tools, Tutorials, and Written Material by Lisa Glanz are protected by South African copyright laws and international treaties. Lisa Glanz owns all rights, including copyrights, to these materials (referred to collectively as “Resources”).

Your right to use the Resources is subject to the terms below and is conditional upon payment made to Lisa Glanz for the applicable usage rights.
Lisa Glanz reserves the right to update or amend these Terms and Licence at any time.

This Licence Agreement (“Licence”) is a legal agreement between you (“Licensee” or “you”) and Lisa Glanz (“Licensor”, “I” or “my”) for downloading, installing, or using the Resources.

You acknowledge that all intellectual property rights in the Resources belong to Lisa Glanz, that the Resources are licensed and not sold, and that you have no rights to them other than as expressly set out in this Licence.

By purchasing and downloading the Resources, you agree to be bound by the terms and conditions of this Licence, including the limitations of liability in Section 5.

If you do not agree to these terms, I cannot license the Resources to you and you must discontinue their use immediately.

By purchasing the Resources from any of my online shops, you consent to the immediate performance of the contract and acknowledge that you will lose your right of withdrawal once the download or streaming of the digital content has begun.

End User Licence Agreement: Brushes, Creative Tools, Tutorials, Written Material (referred to collectively as “Resources”)

1. Grant of Licence

Lisa Glanz grants you a non-exclusive, non-transferable, worldwide single-user right to use the Resources, subject to the conditions and restrictions below.

2. Commercial Use

You may use the Resources to create original artwork, designs, or end products for sale or licence, provided that:

• The work is entirely original and not a copy or derivative of a third party’s creation.
• The final product is a unique, flattened piece in which brushes, stamps, patterns, and textures are integrated as part of the overall composition.
• End Products must not derive their primary value from the original Resource itself and must not allow extraction of the Resource in its original form.
• The Resources must be used as part of a wider creative project, combined with your own time, effort, and skill to produce a new, original artwork.
• You may sell unlimited quantities of your Original Designs or Artworks created with the Resources.
• Pattern and Texture Brushes may be used only as part of a wider design or illustration, as overlays, or to fill areas within your original artwork.

An End Product for Sale can be either a digital or physical item that you or your client intend to sell to more than one person for any type of fee, provided that no third party can extract the original Licensed Resource.

3. Personal Use

You may also use the Resources for personal, non-commercial projects, as long as the Resources are not shared, redistributed, or made accessible to others in any form.

4. Restrictions

To protect my work and your licence, please ensure you do not do any of the following:

• Sub-licence, resell, redistribute, share, or transfer any Resource, whether in its original or modified form.
• Allow anyone other than you, the Licensee, to access or use the Resources.
• Claim authorship of the Resources, even if altered.
• Upload or make the Resources available on any digital asset management system, file-sharing site, or shared drive.
• Resell artwork or templates where the Resources could be extracted in their original form.
• Use the Resources in ebooks or downloadable publications that allow extraction of patterns, textures, or stamps.
• Copy, edit, or repackage Brushes to sell or distribute them in any way.
• Copy or share Tutorials or Written Material included with your purchase.
• Use Pattern, Stamp, or Texture Brushes as-is; they must form part of a wider, original artwork.

If you become aware of any unauthorised duplication or access to any Resource, please notify me by email.

5. Limitation of Liability

• You acknowledge that the Resources have not been developed to meet your individual requirements. It is your responsibility to ensure they meet your needs.
• You may not use the Resources in any unlawful, harmful, defamatory, or offensive manner.
• Lisa Glanz is not liable for any delay or failure to perform obligations due to causes beyond her reasonable control, including but not limited to failure of telecommunications networks, natural disasters, acts of God, industrial action, terrorism, or civil unrest.
• Lisa Glanz does not warrant that operation of the Resources will be uninterrupted or error-free.
• You may not transfer your rights or obligations under this Licence without written consent.
• If any provision of this Licence is deemed unlawful or unenforceable, the remaining conditions will remain in full force.
• Under no circumstances will Lisa Glanz be liable to you or any third party for special, consequential, or incidental damages, including lost profits, savings, or business interruption, even if the item is defective.

This Licence is governed by South African Copyright Law, the Berne Convention, and the Universal Copyright Convention.

6. AI/Machine Learning Use Prohibition

The Licensee agrees that the Resources, including but not limited to brushes, patterns, textures, written materials, tutorials, and any associated files or content, whether in whole or in part, shall not be used to train, develop, test, refine, or otherwise be input into any artificial intelligence systems, machine learning models, neural networks, automated data tools, or similar technologies, whether now known or developed in the future.

The Licensee shall not authorise, permit, or enable any third party to use the Resources for such purposes.

Any use of the Resources in breach of this clause shall constitute a material breach of this Licence Agreement and may result in immediate termination of the licence, without prejudice to any other rights or remedies available to the Licensor.

6. Termination

Lisa Glanz may terminate this Licence immediately by written notice if you commit a material or persistent breach which you fail to remedy within seven (7) days of being notified.

Upon termination:

• All rights granted to you under this Licence shall cease.
• You must immediately stop using the Resources.
• You must pay any outstanding sums due to Lisa Glanz.
• You must delete or remove all Resources from your devices and destroy any tangible copies, certifying that you have done so if requested.
